1. Agreement to these Terms
These Terms of Use (“Terms”) govern your access to and use of the website at tikva.ngo (the “Site”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
2. About TIKVA
TIKVA is a Christ-centered ministry supporting women and children in crisis in Medellín, Colombia. Gifts in support of TIKVA’s work are made to New Hope Community Church (Clovis, California), a 501(c)(3) church, through its missions program. References to “we,” “us,” or “our” mean TIKVA only. New Hope Community Church is a separate organization and is not a party to these Terms.
3. Use of the Site
You may use the Site for lawful, personal, and non-commercial purposes. You agree not to:
- use the Site in any way that violates applicable law or these Terms;
- attempt to gain unauthorized access to the Site, its servers, or related systems;
- interfere with or disrupt the Site, including by introducing malware or overloading our systems;
- scrape, harvest, or collect information about other users; or
- use the Site to harass, harm, or impersonate any person or organization.
4. Donations
Gifts in support of TIKVA’s work are made to New Hope Community Church through its giving platform (Planning Center). Gifts are voluntary. All gifts are made to New Hope and become the property of New Hope, which exercises complete discretion and control over their use. You may indicate a preference that your gift support the missions work in Medellín; preferences are advisory only and are not conditions of the gift. While New Hope makes every effort to honor giver preferences, it retains authority to apply funds to other missions purposes consistent with its exempt purposes. Contributions are tax-deductible to the extent allowed by law, and New Hope issues all giving receipts. Recurring gifts continue until you cancel them through the giving platform. If you believe a gift was made in error, contact us and we will work with you and the giving platform in good faith. We do not store your full payment card details; those are handled by the payment processor.
5. Intellectual Property
The content on the Site, including text, graphics, logos, photographs, and the TIKVA name and mark, is owned by or licensed to TIKVA and is protected by intellectual property laws. You may view and share links to the Site, but you may not copy, reproduce, or distribute our content for commercial purposes without our written permission. Photographs of the people we serve are shared with care and may not be reused.
6. Third-Party Links and Services
The Site links to and relies on third-party services, including New Hope’s giving platform (Planning Center), email platform (Mailchimp), consent manager (Osano), bot-protection service (Cloudflare Turnstile), analytics (Google Analytics), and social media. Those services are governed by their own terms and privacy policies. We are not responsible for the content or practices of third-party websites or services.
7. No Professional Advice
The Site is provided for general informational purposes about TIKVA and its work. It is not legal, financial, medical, or professional advice, and it is not a substitute for advice from a qualified professional.
8. Disclaimers
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the fullest extent permitted by law, TIKVA and its volunteers, staff, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, even if we have been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify and hold harmless TIKVA from any claims, losses, or expenses arising out of your misuse of the Site or your violation of these Terms.
11. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.
12. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page with a revised “Last Updated” date. Your continued use of the Site after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Site will be resolved in the state or federal courts located in California, to the extent permitted by law.
